Subscription Terms
1. REGARDING
These subscription conditions apply to customers with the FREE, PRO, PRO+ (legacy) and PREMIUM subscriptions.
2. ABOUT Mileage Book A/S
Agreement is concluded with Mileage Book A/S, CVR-Nr. 36056924, Godthåbsvej 4, 1.th, DK-8600 Silkeborg, mail: info@mileagebook.com, Phone + 45 70 25 11 00.
2.1. About Mileage Book
Mileage Book is a system for collecting driving data as well as handling and administering driving accounts. The system consists of an app and a website, and data is stored on a cloud-based server solution.
2.2. Language
When entering into agreements with Mileage book, the customer accepts that all information from Mileage Book in connection with the conclusion of the agreement is communicated in Danish or English.
2.3. The use of the Mileage Book
is based on information from the built-in GPS in the customer's smartphone and/or loaned tracker. The Mileage Book app is available for iOS (iPhone) and Android. The app can be downloaded for free via the App Store and Google Play.
2.4. Mileage Book website
is as a minimum compatible with the browsers Google Chrome, Safari, Internet Explorer, and Firefox. To gain access to the site, you must create a subscription via www.mileagebook.com.
2.5. The Mileage Book app collects driving data
and calculates the customer's approximate position using information from cellular, WiFi and GPS networks. Please note that GPS accuracy changes depending on the number of visible GPS satellites. In some cases, it may take several minutes to search for all visible satellites, and accuracy increases gradually during the search.
2.6.Registered driving data
recorded driving data is transferred via WiFi or GPS network to Mileage Book's servers, where driving data is stored. The Mileage Book site is hosted on Microsoft Azure which has data centres all over the world.
2.7. Access to driving data
happens via www.mileagebook.com and depending on the subscription, the site provides access to a wide range of functions, including being able to see trips driven on a map, edit trips driven, create new trips, manage driving allowances, or tax deductions and export data as CSV, Excel, and PDF files.
2.8. Right of usage
The customer can obtain the right of use with one of the defined subscription types. The complete list of subscription types and including functions can be accessed directly via the Mileage Book website.
3. Subscriptions and payment
3.1. Prices
• All prices represented in the Mileage Book are by default excl. 25% VAT. Prices for subscriptions purchased via the App Store can be found in the Mileage Book app.
• Unless expressly agreed between the parties, the subscription price is in accordance with Mileage Book current price list at all times and Mileage Book has the right;
(1.) to increase the subscription price annually with 30 days' prior notice, and
(2.) at any time if it is subject to changes in public fees, taxes, or charges.
If, within 14 days of the provision of such information, the customer notifies Mileage Book in writing of its rejection of the adjustment, the customer may terminate the relevant agreement with Mileage Book with effect from the date one month after Mileage Book receives notification of the customer's rejection.
3.2. Payment channel and method
• Payment can only be made by connecting to a valid credit card.
• Payment takes place via Nets Easy when the customer has accepted Mileage Book's terms and conditions. A payment window will open once the terms are accepted.
• The payment will be debited to the specified payment card, and the subscription will then be available for use.
3.3. Encryption
• All payments are made over secure, encrypted connections.
3.4. Frequency
With a subscription with monthly payment, the payment for the coming month is deducted on the same day of the month as the 1st payment has taken place. If the first payment is made on 10 January, the next payment will be withdrawn on 10 February and so on. If the 1st payment was made on the 29th, 30th or 31st of a month, subsequent payments will be withdrawn on the day of the month or on the last day of the month. With a subscription with prepayment for 1 year, the next payment is deducted on the anniversary of the 1st payment. If the first payment was made on 10 January 2020, the next payment will be withdrawn on 10 January 2021. If the 1st payment was made on 29 February, subsequent payments will be withdrawn on 28 February. Receipt for the purchase is sent by email to the user's created email address immediately after the transaction has been completed.
3.5. App store payment
If payment is made via the App Store, the App Store's payment conditions apply. The subscription is renewed automatically, unless it is cancelled no later than 24 hours before the end of a subscription period. You have the option to turn off automatic renewal in the relevant iTunes account settings after the purchase has been completed.
3.6. Change payment card
When replacing a registered payment card, this must be changed directly via the user's own account, which is accessed via the Mileage Books website.
4. Right of withdrawal
• The customer has the right of cancellation, i.e. right to withdraw from the agreement without reason, if this happens within 14 days from the conclusion of the agreement.
• If the customer wishes to make use of the right of cancellation, this must be done to Mileage Book support per email support@mileagebook.com or telephone +45 70 25 11 01.
• If the customer has paid via the Apple App Store, the subscription must be cancelled from the App Store: Instructions for cancelling an Apple subscription.
5. Service
Online service and support are provided per email and telephone on all subscription types within normal opening hours. Email: support@mileagebook.com. Telephone support: + 45 70 25 11 00. See the Mileage Book website for opening hours.
6. Duration and cancellation
6.1. Notice period
All subscriptions with payment directly at Mileage Book can be cancelled with immediate effect via login from the website and expire before the next payment period begins. Full access to the relevant account is offered until the day the subscription expires.
If the subscription has been paid via the Apple App Store, the subscription must be cancelled from the App Store: Instructions for cancelling an Apple subscription.
6.2. Refunds
Already paid subscriptions are not refunded. Payments made through the App Store and Google Play are handled by these.
6.3. Cancellation notice
A subscription must be cancelled by logging into your own account at https://app.mileagebook.com/account/login and cancelling the subscription or by sending an email to support@mileagebook.com.
6.4. Data deletion
Three months after termination of subscription, the customer's data, including personal information and credit card information, is deleted. Cf. deletion policy in our Privacy Policy.
7. Hardware and equipment
7.1. Hardware lease
• When purchasing the PRO+ (legacy) and PREMIUM subscriptions, loaned hardware in the form of a GPS tracker and other necessary equipment is included.
• Mileage Book sends units to business addresses or parcel shops.
7.2. Hardware return
• With selected subscriptions, Mileage Book lends hardware and equipment to the customer for use for the duration of the subscription.
• When cancelling the subscription, hardware and equipment must be returned to Mileage Book no later than 14 days after the subscription has expired.
• Any potential return costs are borne by the customer.
• If the deadline for return is exceeded, Mileage Book will send an invoice for the purchase of leased hardware and equipment.
• Sender name, company name or address must be included to properly unsubscribe devices.
7.3. Hardware prices
• Price for iBeacon: DKK 360 excl. VAT (DKK 450 incl. VAT)
• Price for GPS tracker: DKK 749 excl. VAT (DKK 936.25 incl. VAT)

8. Other terms
The subscription and the thereof time-limited right of use is personal and may not be transferred or otherwise made available to third parties. The customer is responsible for complying with the terms and conditions.
9. Responsibilities
• Mileage Book provides no guarantee. Mileage Book limits its liability so that Mileage Book's liability for damages can never exceed the remuneration that the customer has paid for the subscription in question.
• If the subscription has had a duration of more than 1 year, the liability for damages is however limited in terms of amount, so that it can request a maximum amount corresponding to the previous year's subscription payment.
• Mileage Book is also not responsible for any kind of indirect loss or consequential damage, including but not limited to loss of operation, loss of time, loss of data, loss as a result of third-party services such as erroneous GPS data, loss of profit and lost tax deductions. Tax deductions for driving are often based on the shortest distance, which does not always correspond to the route chosen by the customer.
• Use of hardware and equipment is at the customer's own risk. Mileage Book is not responsible for use that causes damage to the phone, car or anything else.
10. Changes
• Mileage Book reserves the right to change these trading conditions at any time.
• Mileage Book also undertakes to keep the customer informed if the customer's terms and conditions change in the future.
11. Personal data policy
Mileage Book will have to collect, process and store the customer's GPS data to the extent necessary to be able to offer the Mileage Book's facilities. The customer thus accepts that for all devices associated with the selected subscription, the customer's and the connected devices' GPS location data is collected, processed and stored, and that Mileage Book can make this data available to the third parties that Mileage Book uses for to run the Mileage Book.
By using Mileage Book, the customer and the associated entities agree that personal information and GPS data may be transferred and processed in a country other than the customer's home country. See our Privacy Policy.
12. Legal
Danish legal laws, with the exception of the Danish international choice of law, apply when deciding any dispute with Mileage Book.
Any potential disputes between the customer and Mileage Book can only be settled by the court in Viborg, Klostermarken 10, DK-8800 Viborg, Denmark.
